HK and Macao Tax Professionals May Practise in Qianhai and Shekou

 

Recently, Shenzhen tax authority released the interim measures for managing the practice of Hong Kong and Macao tax‑related professionals in the Shenzhen Qianhai‑Shekou Area of the China (Guangdong) Pilot Free Trade Zone (hereinafter referred to as the interim measures), which came into force on 13 January 2021.  According to the interim measures, qualified tax- related professionals from Hong Kong and Macao are allowed to practise in Shenzhen Qianhai- Shekou Area of Guangdong Free Trade Zone after registering with Shenzhen tax authority.

 

  1. What kind of tax-related professionals can apply for the registration?

 

According to the interim measures, qualified tax-related professionals refer to the permanent residents of Hong Kong and Macao who have obtained the qualification of tax agent in Hong Kong or the qualification of auditor and accountant in Macao.

 

Hong Kong tax agent refers to the person who has obtained the qualification certificate of “certified tax agent” or “chartered tax agent” issued by the Taxation Institute of Hong Kong.

 

  1. What requirements should the applicants meet??

 

According to the interim measures, the applicants shall meet the following requirements:

 

(1)  comply with the laws and regulations of the PRC;

 

(2)  accept the self-discipline management of the Taxation Institute of Hong Kong and the Taxation Research Centre of Macao;

 

(3)   have obtained related qualifications in Hong Kong or Macao for three years and engaged in tax-related business for three consecutive years;

 

(4)  have no record of administrative or industry penalties for misconduct in Hong Kong or Macao in the past three years.

 

  1. Can the applicants practise directly after completing the registration?

 

After registration, the professionals must join a Shenzhen-based tax-related professional service organization before engaging in tax-related professional services, join or establish a tax accountant firm in Shenzhen before engaging in professional tax consultancy, tax planning, tax-related authentication and tax review services, in accordance with the interim measures.
